This Website and Mobile App use cookies and web logs to improve the quality of the site and user experience. By using this Website and App, you agree to allow collection of basic standard information collected by cookies and web logs. No other personal information will be collected unless specifically agreed to by you, the end user.

QualSCORE Privacy Statement

Honest, Fair, and Transparent Introduction

In keeping with our core values of honesty, fairness, and transparency, this introduction provides a brief overview of the QualSCORE Privacy Statement in simple, easy-to-understand language.

First, QualSCORE is not in the data sales game. We use data provided by consumers and businesses to resolve issues and verify accuracy with QualSCORE Quality Audits as well as in our own research into the validity of survey responses.

In other words, data is used for customer complaint resolution and to ensure the ratings and analyses calculated by the QualSCORE software are as accurate as possible.

Any data provided by consumers or businesses is kept secure and private. We don’t sell, rent, or share data with anyone unless we are given express consent from the owner of the data to do so.

QualSCORE provides a website, a mobile-enabled website, and a mobile app: [www.QualSCORE.net and QualSCORE Consumer App (coming soon!)].

The Website and the App allow our members to view customer service-related information for the sole purpose of improving the retail experience and product satisfaction of the end user of their goods and services. However, from time to time in order improve the end user experience, the website and app may request protected health information (PHI) such as demographic identifiers as defined under the Health Information Portability and Accountability Act, Public Law 104-191 (HIPAA) and the Health Information Technology for Economic and Clinical Health Act of 2009, Public Law 111-005 (“HITECH Act”).

This Privacy Statement describes how QualSCORE collects and uses the personal information you provide on, and other information that is collected from your use of the Websites and the App. It also describes who you may contact to request removal of all PHI.

All of your PHI maintained by QualSCORE, including information you provide on the Websites and the App, is also subject to this Privacy Statement.

QualSCORE is committed to protecting the privacy of the users of the Websites and the App. We will use and disclose your personal information only as stated below in this Privacy Statement.

Website and mobile application Privacy Statement

Personal information classified as PHI is used only to conduct ongoing quality improvement activities, including director outreach by our members. Our use and disclosure of an individual's personal information (including PHI) is limited as required by state and federal law. We do not sell or rent personal information about visitors to the Websites or the App.


The Websites and the App have security measures in place that are intended to help protect against the loss, misuse, unauthorized access or alteration of information under our control both during transmission and once the information is received. These measures include encryption of data using the Secure Socket Layer (SSL) system. Despite these measures, the confidentiality of any communication or material transmitted to or from us via the Websites or the App by Internet, text message or email cannot be guaranteed. At your discretion, you may contact us at the mailing address or telephone number listed in the “Questions, complaints, and contacts” section at the end of this Privacy Statement for more information.

Revisions to the Privacy Statement

We may revise this Privacy Statement from time to time as we add new features or modify the way in which we manage information, or as laws change that may affect our services. If we make material changes to our Privacy Statement, we will post notice of this on our Websites and the App prior to the changes becoming effective. Any revised Privacy Statement will apply both to information we already have about you at the time of the change, and any personal information created or received after the change takes effect. We include a version number on this Privacy Statement consisting of the date (year, month, and day) it was last revised. We encourage you to periodically reread this Privacy Statement, to see if there have been any changes to our policies that may affect you.

Website and mobile application visitor data

In addition to web logs, described below, QualSCORE routinely gathers data on website and mobile application activity, such as how many people visit the site or mobile applications, the web pages or mobile screens they visit, where they come from, how long they stay, etc. The data is collected on an aggregate basis, which means that no personally identifiable information is associated with the data. This data helps us improve our content and overall usage. The information is not shared with other organizations for their independent use.

The Websites and the App do not honor a browser’s signal or header request not to track the user's activity.

Data caching by mobile applications

In order to ensure a good user experience, certain data may be temporarily or permanently cached by the App on users’ mobile devices. Any data that is personally identifiable will be encrypted and will not be viewable by anyone without direct access to the user’s mobile device.

Collecting and using and disclosing personal information

Except as disclosed in this Privacy Statement, we do not collect any personally identifiable information about visitors to the Websites or the App. The policies, sources, uses and disclosures of information are outlined in Sections 1 through 19 that follow:

  1. Information collection, use and disclosure

    We collect the following personal information from you:

    • contact information such as name, email address, mailing address, and phone number, age or date of birth
    • preferences information such as preferred first name and the types of emails you’d like to receive from us
    • your location, if you ask for directions to our members’ facilities from your mobile device

    We use and disclose this information to:

    • apply survey information provide by you, the end user, to our proprietary aggregator to develop a QualSCORE for our members
    • respond to customer service requests
    • send you newsletters, text messages or email communications about new products or customer service updates upon your request
    • respond to your questions and concerns
    • improve our website, app, and marketing efforts
  2. Web logs

    As is true of most websites, we gather certain information automatically. We maintain standard Web logs that record data about all visitors and customers who use the Websites, or the App and we store this information for no longer than reasonably useful to carry out its legitimate business purpose, or as legally required. These logs may contain the Internet domain from which you access the site (such as google.com, your browser’s home page, etc.); the IP address which is automatically assigned to your computer when you get on the Internet (a static IP address may be identifiable as being connected to you, while a dynamic address is usually not identifiable); the type of browser and operating system you use; the date and time you visited; the pages or mobile screens you viewed; and the address of the website you linked from, if any. If you sign on to the Websites or the App to use secured features, our Web logs will also contain an individual identifier and show the services you have accessed.

    All Web logs are stored securely and may only be accessed by QualSCORE employees or designees on a need-to-know basis for a specific purpose. QualSCORE uses Web log information to help us design our Websites and the App, to identify popular features, to resolve user, hardware, and software problems, to make the Websites and the App more useful to visitors and for security purposes.

  3. Internet cookies

    We and our partners may place Internet “cookies” or similar technologies on the computer hard drives of visitors to the Websites or the App. Information we obtain helps us to tailor our site and the App to be more helpful and efficient for our visitors. The cookie consists of a unique identifier that does not contain information about your health history.

    You may have software on your computer that will allow you to decline or deactivate Internet cookies, but if you do so, some features of the Websites or the App may not work properly for you. For instructions on how to remove cookies from your hard drive, go to your browser's website for detailed instructions. In addition, further information regarding cookies may be available on other websites or from your Internet service provider. Safari, Chrome, Firefox, Internet Explorer and iOS browsers are commonly used browsers.

  4. Emails, SMS text messaging, and direct phone calls

    QualSCORE is designed to provide customer service information to our members to improve their business. As you, the end user, fill out a QualSCORE survey, you may be asked to provide personal contact information for our members to reach out to resolve customer service issues. While we do supply these vendors with email addresses or mobile telephone numbers, your email address or telephone number is never used for any purpose other than to communicate with you on our behalf. QualSCORE never shares any information, other than your email address or telephone number, with our members, which may only share this information with its authorized subcontractors. Only those members who have signed a Business Associate Agreement (BAA) as defined by HIPAA will have access to your information. For more information on the BAA process, please contact us at the address listed in the “Questions, Comment, Complaints” section below.

    Even if you have given us permission to send emails or text messages to you, or contact you via direct phone calls, you may revoke that permission at any time by contacting us at the address listed in the “Questions, Comment, Complaints” section below.

  5. Application for QualSCORE Membership

    If you are a recreational or medical cannabis provider and wish to apply for QualSCORE membership through the Websites or the App, you will be asked during the application process to disclose certain personal information so that we can evaluate your eligibility, and you will be asked to verify the truthfulness of your answers.

  6. Messages and transactions

    Comments or questions sent to us using email or secure messaging forms will be shared with QualSCORE staff and health care professionals who are most able to address your concerns. We will archive your messages once we have made our best effort to provide you with a complete and satisfactory response.

  7. Data integrity and correction

    Requests to view and correct personal information from the Websites or the App may be submitted using the contact information in the “Questions, complaints, and contacts” section below.

    If your personal information changes, or to update or request deletion of information collected on our Websites or the App, or if you believe a third party has provided us with your personal information and you would like to request that it be edited or removed from our database, please use the contact information in the “Questions, complaints, and contacts” section below. We will respond to all access requests within 30 days.

  8. Children

    Because our members provide medical and recreational cannabis services (cannabis is a Schedule I controlled substance governed by applicable local, state, and federal statutes) users of our Website or App must be at least 21 years of age. We do not knowingly collect personally identifiable information from youth under the age of 21. If QualSCORE is made aware of collecting information from youth under 21 we will delete this information.

  9. Disclosures

    We may disclose personal information to any person performing audit, legal, operational, or other services for us. We will use information which does not identify the individual for these activities whenever reasonably possible. Information disclosed to our members for operational purposes may not be re-disclosed to other third parties by such a vendor or contractor, except as permitted by QualSCORE, our members (subject to provisions of the BAA) and applicable law.

    We may also disclose your personal information:

    • as required by law, such as to comply with a subpoena, or similar legal process
    • as described in HIPAA for PHI
    • when we believe in good faith that disclosure is necessary to protect our rights, protect you or others from threats of imminent harm, investigate fraud or other activity in violation of the law, or respond to government requests (including to meet national security or law enforcement requirements)
    • to protect the security and reliability of the Websites and the App
    • to any other third party with your expressed prior consent to do so
  10. Opt out

    Use of the QualSCORE platform implies consent to subsections 2 and 3 above (“web logs” and “cookies” respectively). However, no other personal information will be collected unless specifically agreed to by actively consenting to this entire Privacy Statement. If at any time you wish to opt out of storage or transmission of your personal information, you may do so by contacting us as described in the “Questions, Complaints, Contacts” section below.

  11. Data retention

    We will retain your information for as long as our member’s account is active or as needed to provide them services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

  12. Social media

    Our members’ individual websites may include Social Media Features, such as the Facebook button. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features are either hosted by a third party or hosted directly on the member’s own websites. Your interactions with these Features are governed by the privacy statement of the company providing them and are not the subject of any oversight by QualSCORE.
